5-Second Response Guarantee — Terms & Conditions

1. Eligibility. This guarantee applies to accounts that have completed onboarding, connected an active business phone number and calendar, and been live on the ChatBotNexus system for a minimum of 14 consecutive calendar days ("Guarantee Period").
2. Qualifying Volume. The Guarantee Period must include a minimum of fifteen (15) inbound contact events — defined as missed calls, incoming text messages, or website chat sessions initiated by a third party — routed through the client's connected phone number or website widget.
3. Performance Standard. "Response failure" means the system did not send an automated text-back within 5 seconds of a missed call, or did not deliver an initial chat reply within 1 second of a website visitor message, measured by ChatBotNexus's internal system logs.
4. Refund Trigger. If three (3) or more qualifying contact events during the Guarantee Period experienced a response failure as defined above, the client may request a refund of the one-time setup fee ($1,500) by submitting a written request within thirty (30) days of the end of the Guarantee Period.
5. Exclusions. This guarantee does not cover: (a) failures caused by the client's phone carrier, internet, or calendar provider outages; (b) incomplete or delayed setup caused by the client's failure to provide required account access, pricing information, or service area details; (c) spam, robocalls, or non-business inquiries.
6. Sole Remedy. Refund of the one-time setup fee is the client's sole and exclusive remedy under this guarantee. The monthly subscription fee is non-refundable and may be cancelled at any time per the Terms of Service.
7. Verification. ChatBotNexus will provide system response-time logs to substantiate any refund determination upon request.
8. This guarantee is offered as a good-faith service commitment and does not constitute a warranty of business results, revenue, or sales outcomes.
